People v. Beachem, 1-05-0045

In a prosecution for possession of a controlled substance with intent to deliver the judgment is affirmed over claims of error regarding: 1) his conviction of possession of a controlled substance with intent to deliver; 2) the five dollar payment to the Spinal Cord Injury Paralysis Cure Research Trust Fund; and 3) the trial court's order regarding the extraction and storing of defendant's DNA. However, the court amends: 1) the mittimus to reflect a total of 204 days' credit pursuant to section 5-8-7; 2) the Costs and Fines order to reflect a total of 1,020 dollars to be credited against the 3,000 controlled substance assessment; and 3) the order in order to strike the 20 dollar Violent Crime Victims Assistance Fund penalty.
