People v. Sims, 1-04-2709

In a prosecution for first degree murder and armed robbery the judgment is reversed and remanded where: 1) the evidence at his trial was sufficient as a matter of law to sustain his conviction for the charge of first degree murder; 2) there is insufficient evidence to find that the exclusion of the hospital protocols explaining the conclusion that the victim died from respiratory arrest not related to the armed robbery or any evidence of negligence would have changed the outcome of the proceedings; and 3) defendant was prejudiced by defense counsel's failure to request a compulsion instruction.
