Appellate Court of Illinois

Allianz Ins. Co. v. Guidant Corp., 2-05-1168

A contempt order against defendant-appellant for refusing to produce certain materials demanded by the plaintiff-appellee is vacated where: 1) the court did not err in granting the motion to compel since neither the attorney client privilege nor the work product doctrine can bar discovery of the documents; 2) choice of law analysis results in an application of Illinois law and 3) the order is vacated since defendant-appellant's refusal to comply constituted a good faith effort to secure an interpretation of the privileges in question.
