Appellate Court of Illinois
People v. Rodriguez, 1-04-3546
Conviction and sentence for possession of a controlled substance is affirmed over claims of error regarding: 1) his right to a new trial because the record does not indicate that he knowingly and intelligently waived his right to confrontation when his attorney stipulated that a proper chain of custody was maintained over items recovered from the defendant; 2) the court's order to pay 5 dollars to the Spinal Cord Injury Paralysis Cure Research Trust Fund violated his due process rights because it is not rationally related to the offense of possession.
