Steadfast Ins. Co. v. Caremark Rx, Inc., 1061221

An order of the circuit court denying plaintiff's motion for restitution of costs it paid defending defendant is affirmed where the circuit court could not enter summary judgment on a theory of recovery not pled in the complaint. Judgement is reversed where the circuit court erred in denying plaintiff leave to file a second amended complaint. (Corrected opinion)
