Appellate Court of Illinois

People v. McGee, 1-05-3020

A conviction and sentence for burglary is affirmed over claims of error regarding: 1) denial of defendant's motion to quash arrest and suppress evidence due to lack of probable cause; 2) failure to prove defendant guilty beyond a reasonable doubt where the only evidence against him was his possession of the proceeds from the burglary; and 3) ineffective assistance of counsel for failing to raise objections to jury instructions, to the admission of the victim's identification testimony, and to testimony identifying the defendant in a police show up procedure.
