People v. Carodine, 1-05-2775

A conviction and sentence on two counts of possession of a controlled substance is affirmed and modified as to the fines imposed over claims of error regarding: 1) denial of his pretrial motion to suppress evidence; 2) failure to prove defendant guilty beyond a reasonable doubt; 3) misstatement of evidence by the trial court in its findings; 4) the imposition of a five dollar fee for the Spinal Cord Paralysis Cure Research Trust Fund as unconstitutional; 5) the assessment of a twenty dollar Violent Crime Victims Assistance Fund fine as improper; and 6) the failure to offset the five hundred dollar controlled substance fine and the one hundred dollar trauma fund fine by a five dollar per day pre-sentence credit.
