N. Trust Co. v. Knox, 1-06-1713
Summary judgment for defendant holding that he is entitled to a share of the trust principal in an action brought by the trustee in order to seek instructions from the trial court on how to distribute the trust principal upon termination of the trust is affirmed where: 1) the trust revolved around the lives of the measuring lives; and 2) the principal vested upon termination of the trust and not at the time of one of the first taker's death.
