First Merit Realty Services, Inc. v. Amerly Square Apartments, LP, 1-05-3556

A judgment affirming an arbitration award for plaintiffs arising out of defendant's termination of the property management contracts between the parties is vacated where: 1) the arbitrators exceeded their authority in awarding damages to plaintiff when the defendants complied with the management agreements where they provided 30 days advance notice; and 2) the arbitrators improperly considered parol evidence when they reformed the contracts despite their unambiguous language.
