Franqui v. State of Florida, SC05-830

In defendant's motion to vacate his conviction for first-degree murder and sentence of death, circuit court's order denying postconviction relief is affirmed where: 1) the circuit court had before it competent, substantial evidence to find that defendant is not mentally retarded; 2) the postconviction court did not err in summarily denying defendant's claims of ineffective assistance of counsel; and 3) defendant's claims that the state withheld favorable, material evidence in violation of Brady and that it knowingly presented false testimony in violation of Giglio, are without merit.
