Westgate Miami Beach, Ltd. v. Newport Operating Corp., SC09-1881

In a suit arising out of a series of commercial disputes involving timeshare agreements at a hotel, the third district court's affirmance of the trial court's denial of plaintiff's motion to assess prejudgment interest is quashed and remanded as, a final judgment reserving jurisdiction to award prejudgment interest is a final appealable order but the trial court does not lose jurisdiction to determine prejudgment interest in a manner similar to that in which the trial court addresses attorneys' fees and costs.
