Durousseau v. State of Florida, SC08-68

Conviction of defendant for first degree murder and a sentence of death are affirmed where: 1) the trial court did not abuse its discretion in admitting the Williams rule evidence of two other murders; 2) the trial court did not err in denying the motion for judgment of acquittal as to the robbery; 3) defendant's challenge to the trial court's finding of the pecuniary gain aggravator is rejected; 4) evidence is sufficient to support defendant's first degree murder conviction; 5) the trial court did not abuse its discretion in rejecting the expert's opinion in favor of conflicting lay testimony regarding defendant's mental mitigation; 6) defendant is not entitled to relief on his Ring claim; and 7) the imposition of death sentence is proportionate in this case.
