Mendenhall v. State of Florida, SC09-400
In a prosecution of defendant for attempted second-degree murder with a firearm, the Fifth District's reversal of trial court's sentence and remanding for reimposition of the original sentence is approved as defendant was properly sentenced to thirty-five years with a thirty-five-year mandatory minimum, notwithstanding the statutory maximum of thirty years contained in section 775.082 for defendant's offense as, under section 775.087(2)(3), the trial court has discretion to impose a mandatory minimum within the range of twenty-five years to life.
