Supreme Court of Florida
Schoenwetter v. State of Florida, SC08-2271
In defendant's petition for habeas relief, seeking to vacate his convictions for first degree murder and sentences of death, the circuit court's order is affirmed and the petition denied where: 1) defendant's counsel did not render ineffective assistance; 2) the circuit court did not err in denying an evidentiary hearing on defendant's claim that Florida's lethal injection was unconstitutional; 3) defendant's claim of ineffective assistance during the penalty phase is rejected; 4) defendant's challenge to his death sentence is procedurally barred; and 5) a claim of cumulative error is rejected.
