Supreme Court of Florida
Clark v. State of Florida, SC07-2318
Postconviction court's order denying defendant's motion to vacate a judgment of conviction of first degree murder and a sentence of death is affirmed where: 1) defendant's ineffective assistance of counsel claim is meritless; and 2) defendant's claim of newly discovered evidence was properly denied as he failed to raise the claim, that another individual confessed to being the shooter in the murder for which defendant was convicted, within one year of discovering it and failed to raise the claim in his pleadings at all.
