Zommer v. State of Florida, SC08-494

Conviction of defendant for first-degree murder of a senior citizen and sentenced to death are affirmed where: 1) there is sufficient evidence to support the conviction for premeditated murder; 2) sufficient evidence supports finding of the cold, calculated, and premeditated aggravating circumstance by the trial court; 3) trial court did not err in finding that the murder was heinous, atrocious, and cruel; 4) trial court did not err in rejecting defendant's statutory mitigating circumstances; and 5) the death sentence is proportionate and constitutional.
