Supreme Court of Florida
Conde v. State of Florida, SC06-1998
Postconviction court's order denying relief to a defendant convicted of first-degree murder and sentenced to death is affirmed where: 1) the prosecutor's comments were insufficient to undermine confidence in the outcome as required under the Strickland prejudice standard; 2) defendant failed to establish what, if any, negative result occurred in making an ineffective assistance of counsel claim; and 3) defendant's Ring claim was not improperly denied, as it is procedurally barred.
