Hurst v. State of Florida, SC07-1798

Sentence of defendant convicted of capital murder is vacated and remanded for a new penalty phase proceeding as trial counsel was ineffective in failing to investigate and present evidence of mental mitigation. Trial court's order denying relief as to the remainder of his claims is affirmed.
