Hobbs v. State of Florida, SC08-615
For purposes of admitting a defendant's confession in a sexual abuse case pursuant to Florida Statutes section 92.565, a trial court may consider a victim's recantation when determining whether the State is unable to prove the existence of each element of the charged offense.
