Supreme Court of Florida
Bailey v. State of Florida, SC07-748
Death row inmate's conviction and sentence affirmed. Death sentence was not disproportionate where defendant killed police officer and afterwards carjacked a truck to escape. Prosecutor did not commit fundamental error by describing Defendant as "evil" and asking jurors to look at one another from 18-24 inches away, the distance from which the victim was shot three times.
