Walton County v. Stop the Beach Renourishment, Inc., SC06-1447
In an action alleging an unconstitutional taking of private land in a beach-restoration project, affirmation of an order issuing a permit to proceed with the restoration is quashed where the Beach and Shore Preservation Act on its face did not unconstitutionally deprive upland owners of littoral rights without just compensation.
