Auto-Owners Ins. Co. v. Pozzi Window Co., SC06-779
In proceedings involving a certified question from the U.S. Court of Appeals for the Eleventh Circuit, the case is returned to the Eleventh Circuit where: 1) when the Eleventh Circuit certified the question, it did not have the benefit of the decision in United States Fire Insurance Co. v. J.S.U.B., Inc., 979 So. 2d 871 (Fla. 2007), which held that a subcontractor's defective work can constitute an "occurrence" under a post-1986 standard form commercial general liability policy; but 2) the Eleventh Circuit used the terms "defective windows" and "defective installation" interchangeably, creating a determinative issue of fact which required the case to be returned to the Eleventh Circuit.
