Supreme Court of Florida

Florida Bar v. Valentine-Miller, SC06-1629

In attorney disciplinary proceedings, a referee's report recommending that respondent-attorney be found guilty of professional misconduct and be suspended from the practice of law for three years is approved as to its findings of fact and recommendations as to guilt but the court rejects findings of mitigation and the recommended discipline. Instead, due to the serious nature of the misconduct, as well as the harm respondent caused, the court finds disbarment is warranted.
