Marshall v. State of Florida, SC05-2379
In a death penalty case, denial of petitioner's motion for postconviction relief is affirmed over claims of error regarding whether the trial court erred by: 1) failing to adequately question former jurors about alleged jury misconduct and by restricting the scope of its inquiry; 2) refusing to take one individual's testimony and requiring defendant to file a successive motion for postconviction relief, and failing to expand the scope of the inquiry of the former jurors; and 3) by not allowing counsel to informally interview a former juror and by limiting the manner and scope of his questioning.
