State of Florida v. Rubio, SC06-157
A district court of appeals decision, which partially reversed dismissal of all racketeering and white collar crime charges against defendants, is reversed in part where, contrary to the district court's conclusions: 1) Florida Statutes section 817.505 (2002), which prohibits "patient brokering," is constitutional; and 2) the information charged the correct units of prosecution as the state was not limited to prosecuting only the arrangement to refer patients under the statute.
