Willacy v. State of Florida, SC05-189, SC05-2021
In a death penalty case, an order denying defendant's motion for postconviction relief and a petition for habeas relief are affirmed and denied, respectively, over claims of error regarding: 1) denial of an evidentiary hearing on certain claims of a motion for postconviction relief; 2) ineffective assistance of counsel based on multiple grounds; 3) a failure to retroactively apply the decision in Lowrey v. State, 705 So. 2d 1367 (Fla. 1998); and 4) denial of defendant's motion for postconviction DNA testing.
