Supreme Court of Florida
Kelso v. State of Florida, SC05-597
The opinion of in State v. Getz, 435 So. 2d 789 (Fla. 1983), remains the controlling law following the 1988 amendment to Florida Statutes section 775.021 because section 812.014 constitutes a clear expression of legislative intent that thefts of the various enumerated properties under the statute be punished separately, even when the offenses arise from the same criminal episode. Thus, the multiple theft convictions in the case at hand are permitted under Florida law and do not violate double jeopardy principles.
