In attorney disciplinary proceedings involving allegations of misconduct arising from attorneys' entering into a secret "engagement agreement" with the DuPont Corporation while representing clients in Benlate cases against DuPont, a report recommending that respondent-attorney be found guilty of professional misconduct and recommending several sanctions is disapproved to the extent it recommended a public reprimand and probation. Instead, a two year suspension is imposed and respondent is ordered to disgorge his portion of a prohibited fee paid by DuPont.
