Supreme Court of Florida
Florida Bar v. Brownstein, SC04-2460
A referee's report recommending that an individual be found guilty of professional misconduct and suspended from the practice of law for three years is approved in part as to the findings of fact and recommendations as to guilt. However, findings regarding aggravating and mitigating circumstances, as well as the recommended discipline, are rejected and instead respondent is disbarred for five years because the mitigation in the case did not outweigh the seriousness of the offenses, which primarily involved client trust accounting issues.
