Supreme Court of Florida
Schmidt v. McDonough, SC01-2252
The filing of a mandamus petition raising a gain time claim is not free of costs, and although such petitions are exempt from the prepayment and lien requirements of the prisoner indigency statute, Fla. Stat. section 57.085, they continue to be subject to the certification requirements of the general indigency statute. "Mixed" petitions, petitions where civil claims are piggy-backed onto gain time claims, are not exempt from the prepayment and lien requirements of the prisoner indigency statute.
