Tobin v. Michigan Mut. Ins. Co., SC05-214
In a suit brought by plaintiffs injured or killed in accidents with uninsured drivers while operating or occupying vehicles leased from Ford seeking to recover under an insurance policy issued to Ford by defendant-insurer, the court finds that the district court properly reformed the policy to reflect the mutual intent of the contracting parties that plaintiffs were not "named insureds" under the policy, and plaintiffs are not entitled to uninsured/underinsured motorist coverage under the policy as reformed.
