Supreme Court of Florida

Swafford v. State of Florida, SC06-242

In an appeal brought by an inmate convicted of first-degree murder and sexual battery and sentenced to death, the court finds that a circuit had complied with a prior order from the Supreme Court of Florida regarding DNA testing of certain pieces of evidence and affirms the circuit court's order to that effect, without prejudice to defendant presenting DNA issues in further proceedings under rule 3.851.
