Melton v. State of Florida, SC04-1689, SC05-1423

In a death penalty murder case, denial of a motion to vacate the death sentence and a petition for a writ of habeas corpus are affirmed and denied, respectively, over claims of error regarding: 1) ineffective assistance of counsel; 2) Brady and Giglio violations; 3) newly discovered evidence; 4) prosecutorial misconduct; 5) the jury's composition; 6) a reference to defendant's lack of remorse in the order denying postconviction relief; 7) jury instruction; 8) the constitutionality of Florida's capital sentencing scheme under Ring; and 9) whether defendant's conviction violates Roper v. Simmons, 543 U.S. 551 (2005).
