Delgado v. State of Florida, SC04-2274

Defendant's convictions and death sentences upon retrial on murder charges are affirmed over claims of error regarding: 1) double jeopardy; 2) denial of a mistrial based on prosecutorial misconduct; 3) admission of evidence; 4) jury instructions; 5) the constitutionality of Florida's capital sentencing scheme in light of Apprendi and Ring; 6) sustaining an objection to defense counsel-s comments during closing argument regarding the state-s failure to present DNA evidence; 7) cumulative error; 8) sufficiency of the evidence; and 9) the proportionality of the sentences.
