Supreme Court of Florida

State of Florida v. Paul, SC05-656

A decision of the district court is affirmed to the extent that it found two criminal episodes occurred and that defendant could not be convicted of both a violation of Florida Statutes section 800.04(6)(a)(1) and section 800.04(5)(a) for certain acts. However, a determination that application of Florida section 775.021 prohibited his convictions for lewd and lascivious conduct and lewd and lascivious exhibition for certain acts is quashed.
