Cardegna v. Buckeye Check Cashing, Inc., SC02-2161
A previous decision in the matter is withdrawn on remand from the U.S. Supreme Court pursuant to Buckeye Check Cashing, Inc. v. Cardegna, 126 S. Ct. 1204 (2006). A borrower's claim that a contract was void ab initio under Florida law and public policy must be resolved by arbitration where there was no separate claim that an arbitration provision in the contract itself was unenforceable.
