BUNKLEY v. STATE OF FLORIDA, SC01-297

The construction of the statute under which petitioner was convicted, which was set forth in L.B. v. State, 700 So. 2d 370 (Fla. 1997), was a change in the law to the extent that it differed from the prior construction of the statute in final decisions of the district courts and should have no effect on defendant's final judgment of conviction and sentence.
