District Court of Appeal of Florida

Sell v. Sell, 3d06-0994

In a dissolution action, denial of payment of attorneys' fees from the proceeds of the sale of the marital home is reversed where: 1) the final judgment of dissolution of marriage expressly provided for the payment of the former-wife's fees and costs from the assets being distributed, including the proceeds from the sale of the marital home; 2) the designation of homestead property does not bar imposition of a lien on marital property distributed to one of the partners; and 3) homestead property may be subjected to equitable liens where fraudulent, reprehensible or egregious conduct is demonstrated.
