District Court of Appeal of Florida
C.M. v. Dep't of Children & Families, 1D05-5351
A judgment terminating an incarcerated father's parental rights over a child is affirmed, but the matter is remanded for further proceedings relating to whether the child-s manifest best interests would allow the child to be placed for adoption by the paternal aunt, because the decision to commit the child to the Department for subsequent adoption was made before the Department completed its ongoing home study of the aunt. (Opinion on rehearing)
