Haines City HMA, Inc. v. Carter, 2D06-1413

In a lawsuit brought by a labor and delivery nurse against her employer under the anti-retaliation provision of the Florida Civil Rights Act (FCRA), a judgment and award for plaintiff is affirmed in part, but reversed in part as to an award of attorney's fees where federal case law precludes the use of a multiplier to enhance an attorney's fee award in a Title VII case, and the trial court erred in finding that precedent permitted the upward adjustment of the lodestar fee to compensate for the contingent nature of this employment discrimination case.
