District Court of Appeal of Florida

Medinis v. Swan, 2D05-1640

In a dispute arising after a joint business venture failed, a judgment for plaintiff on contract, breach of the duty of good faith, promissory estoppel, and conversion claims is affirmed in part, but reversed in part where: 1) a verdict form failed to provide for a jury finding on the amount of damages for certain claims; and 2) it was not possible, as a matter of law, for defendant to convert certain stock, and the conversion count should not have been submitted to the jury.
