Denial of motion to dismiss or motion to stay litigation pending arbitration and motion to compel arbitration in a suit regarding breach of a construction contract and RICO claims is reversed where: 1) all of the defendants may compel the plaintiffs to arbitration; 2) all of the plaintiffs' and defendants' claims are arbitrable; and 3) the defendants did not waive their contractual arbitration rights by simultaneously filing counterclaims with requests to stay litigation and compel arbitration.
