Alpaugh Plumbing & Supply of Tampa, Inc. v. Fee-Walters Corp., 2D06-229
In a dispute over payment for work performed by plaintiff on a residence under construction pursuant to a contract between the parties, a judgment entered against defendants and denial of attorney's fees and costs is affirmed in part, but reversed as to the denial of fees and costs where an earlier judgment in the matter was nonfinal because it did not dispose of all of the claims in the complaint, and thus, the trial court erred in denying the motion for fees as untimely.
