District Court of Appeal of Florida

Albritton v. White, 2D06-5172

A petition for a writ of habeas corpus, arising from petitioner's arrest on a capias due to her failure to appear at arraignment, is granted where the trial court's blanket policy announced in a memorandum, ordering all defendants and counsel to appear at arraignment, arbitrarily denied defendant the privilege afforded by Florida Rule of Criminal Procedure 3.160.
