Scarlett v. Ouellette, 3d05-0704
Judgment for defense in a medical malpractice suit containing attorney's fees and sanctions is affirmed where: 1) certain expert testimony was not a surprise, prejudicial, or a disruption of the trial; 2) photographs submitted by the defense were properly authenticated and relevant; and 3) the trial court did not improperly restrict an expert from commenting on the sufficiency or credibility of the opposing expert's evidence or testimony.
