District Court of Appeal of Florida

Goswani v. Lennox Indus., Inc., 1D05-5166

In a contract action brought by the inventor of a patented air filtration and purification system who transferred ownership of the system and supporting patents, summary judgment against the inventor is reversed where the trial court reversibly erred in concluding at summary judgment that the inventor was not a third-party beneficiary of an Asset Purchase Agreement between the original transferee and defendant, and that defendant did not assume any liability for the transferee's obligation for royalty payments to the inventor.
