Maloy v. Bd. of County Comm'rs of Leon County, 1D05-4445
In an action brought by a county commissioner to recover legal fees incurred in defending an ethics complaint, summary judgment for the county-s Board of County Commissioners is affirmed where, although contrary to the trial court-s ruling, the doctrine of sovereign immunity does not bar plaintiff's claims, the underlying ethics proceeding did not arise out of and in the course of plaintiff's employment with the Board while he served a public purpose.
