District Court of Appeal of Florida
Leon County, Florida v. Dobson, 1D05-4326
An order finding a county liable for attorney's fees incurred by a county commissioner who successfully defended himself against criminal charges is affirmed where, although the circuit court erred in determining that a county policy constituted a contract of indemnity for county commissioners, nevertheless common law entitled the commissioner to have his legal fees reimbursed by the public since his actions arose out of his official duties while he served a public purpose.
