An order adjudicating mother's five children dependent is reversed where the trial court erred in concluding that she had neglected the children by allowing a man who was two months out of prison to spend nights in her home and have a relationship with her children, as such acts did not constitute neglect as a matter of law, and any harm to the children was caused by the felon's heat-of-passion crime of shooting into mother's apartment after she ended their relationship.
