Copeland v. Albertson's Inc., 2D05-2867
In a suit brought by a robber seeking compensation for injuries he suffered as a result of Albertson's and its employee's alleged intentional torts and negligence after they chased him down and apprehended him, summary judgment for defendants is reversed where: 1) insofar as the judgment was founded on the section 776.085 defense relating to convicted felons, it was procedurally defective and could not be sustained on that defense; and 2) defendants failed to meet their burden of proof on their summary judgment ground that plaintiff could not prove his case because he could not remember the incident.
